1. Introduction
Welcome to Banh Mi Travel. These Terms and Conditions govern your use of our travel services, website, and any bookings made through our platform. By making a booking or using our services, you agree to be bound by these terms. Please read them carefully before proceeding.
Banh Mi Travel operates as a licensed travel agency specializing in Vietnam travel experiences, including guided tours, custom itineraries, and travel-related services throughout Vietnam and Southeast Asia.
2. Definitions
- "Company," "we," "us," or "our" refers to Banh Mi Travel.
- "Customer," "you," or "your" refers to any person making a booking or using our services.
- "Trip" refers to any tour, travel package, or service provided by Banh Mi Travel.
- "Booking" refers to a confirmed reservation for any of our services.
- "Travel Documents" refers to passports, visas, vaccination records, and other required documentation.
3. Booking and Confirmation
3.1 Making a Booking
Bookings can be made through our website, by email, or by telephone. A booking is considered confirmed only after we have received the required deposit and sent you a written confirmation. The person making the booking must be at least 18 years of age and accepts these terms on behalf of all travelers included in the booking.
3.2 Deposit and Payment
A non-refundable deposit of 30% of the total trip cost is required to secure your booking. The remaining balance is due 60 days before the trip departure date. For bookings made within 60 days of departure, full payment is required at the time of booking.
3.3 Payment Methods
We accept payment via bank transfer, credit card, and other methods as specified during the booking process. All payments must be made in the currency specified in your invoice. Any bank fees or currency conversion charges are the responsibility of the customer.
4. Pricing and Inclusions
4.1 Trip Prices
All prices are quoted in the currency specified and include the services listed in the trip description. Prices are subject to change until a booking is confirmed. We reserve the right to adjust prices due to currency fluctuations, fuel surcharges, or changes in local taxes and fees beyond our control.
4.2 What's Included
Unless otherwise specified, our trip prices typically include accommodation, transportation as described, guided services, and meals as listed in the itinerary. International flights, visa fees, travel insurance, personal expenses, and optional activities are generally not included unless explicitly stated.
4.3 Single Supplements
Solo travelers may be required to pay a single supplement for private accommodation. We may offer room-sharing arrangements where available, subject to availability and compatibility with other travelers.
5. Cancellation and Refunds
5.1 Cancellation by Customer
Cancellations must be made in writing via email. The following cancellation fees apply based on the number of days before departure:
- More than 60 days: Loss of deposit (30%)
- 30-60 days: 50% of total trip cost
- 15-29 days: 75% of total trip cost
- Less than 15 days: 100% of total trip cost (no refund)
5.2 Cancellation by Banh Mi Travel
We reserve the right to cancel a trip due to insufficient participants, safety concerns, natural disasters, political instability, or other circumstances beyond our control. In such cases, you will receive a full refund or the option to transfer to an alternative departure date or trip of equivalent value.
5.3 Trip Modifications
We reserve the right to make minor changes to itineraries due to local conditions, weather, or operational requirements. Significant changes will be communicated as soon as possible, and you may be entitled to cancel with a full refund if the changes materially affect the trip.
6. Travel Requirements
6.1 Passports and Visas
It is your responsibility to ensure you have a valid passport with at least 6 months validity beyond your return date and any required visas for Vietnam and any transit countries. Banh Mi Travel can provide guidance but is not responsible for any issues arising from inadequate travel documentation.
6.2 Health Requirements
You are responsible for checking and fulfilling any health requirements, including vaccinations and medications. We recommend consulting a travel health professional before your trip. Customers must disclose any medical conditions that may affect their ability to participate in trip activities.
6.3 Travel Insurance
Comprehensive travel insurance is mandatory for all Banh Mi Travel customers. Insurance must cover trip cancellation, medical expenses, emergency evacuation, and personal liability. Proof of insurance may be requested before departure.
7. Customer Responsibilities
7.1 Conduct
Customers are expected to behave respectfully toward guides, local staff, fellow travelers, and local communities. We reserve the right to remove any customer whose behavior is disruptive, dangerous, or disrespectful, without refund.
7.2 Fitness and Ability
Some trips involve physical activities such as walking, hiking, or cycling. It is your responsibility to ensure you are physically capable of participating in the activities described. Please inform us of any limitations at the time of booking.
7.3 Compliance with Laws
Customers must comply with all local laws and regulations in Vietnam and any other countries visited. Any illegal activity will result in immediate termination of services without refund.
8. Liability
8.1 Limitation of Liability
Banh Mi Travel acts as an intermediary between you and various service providers including hotels, transport operators, and activity providers. While we carefully select our partners, we cannot be held liable for acts, omissions, or failures of third-party service providers.
8.2 Force Majeure
We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, epidemics, government actions, or transportation disruptions.
8.3 Personal Belongings
Banh Mi Travel is not responsible for loss, theft, or damage to personal belongings during the trip. We recommend keeping valuables secure and obtaining appropriate insurance coverage.
9. Intellectual Property
All content on our website, including text, images, logos, and trip itineraries, is the property of Banh Mi Travel and protected by copyright laws. You may not reproduce, distribute, or use our content without prior written permission.
10. Complaints and Disputes
10.1 Complaints Procedure
If you have a complaint during your trip, please inform your guide or our local representative immediately so we can attempt to resolve the issue. Any complaints must be submitted in writing within 30 days of your return date.
10.2 Governing Law
These terms and conditions are governed by the laws of Vietnam. Any disputes shall be subject to the exclusive jurisdiction of the courts of Vietnam.
11. Privacy
Your personal information is handled in accordance with our Privacy Policy. By making a booking, you consent to the collection and use of your data as described therein.
12. Amendments
We reserve the right to update these Terms and Conditions at any time. Changes will be posted on our website and will apply to bookings made after the date of publication. Existing bookings will be governed by the terms in effect at the time of booking.
